1. GENERAL PROVISIONS

1.1. The website WWW.METALINIAI.LT (hereinafter referred to as the Website) is owned and administered by UAB “Dotekas” (company code 304062194; registered office: Jovarų g. 3, LT-47192, Kaunas) (hereinafter referred to as METALINIAI.LT).

1.2. These Privacy Protection Rules are a written document that sets out the provisions for ensuring privacy (hereinafter referred to as the Privacy Rules), which apply to all persons using the Website and Services. The terms used in the Privacy Policy correspond to the terms defined in the Terms of Use of the Website (hereinafter referred to as the Terms) (use of the Website, Service, etc.) and their meaning, except where certain terms are defined separately in these Privacy Rules.

1.3. By using the Website and/or Services in any manner and form, the Visitor unconditionally and irrevocably undertakes to comply with all the requirements set forth in these Privacy Rules. If the Visitor does not agree to unconditionally and irrevocably accept and comply with all obligations set forth in these Privacy Rules, the Visitor shall not have the right to use the Website and/or Services.

1.4. METALINIAI.LT has the right to unilaterally amend and/or supplement these Privacy Rules at any time. Amendments to the Privacy Rules shall take effect upon their publication on the Website. If the Visitor continues to use the Website and/or Services after the publication of changes and/or additions to the Privacy Policy, it shall be deemed that he/she unambiguously agrees to all changes and/or additions to the Privacy Policy. If the Visitor does not agree with the amended and/or supplemented Privacy Policy, they lose the right to use the Website and/or Services.

1.5. The collection, processing, and storage of personal data is governed by these Privacy Rules, the Law on Legal Protection of Personal Data of the Republic of Lithuania, and other legal acts.

2. DATA COLLECTED BY METALINIAI.LT

2.1. Use of or full access to the Website and Services is only possible after completing the registration procedure on the Website. The registration procedure is performed by clicking on the relevant link on the Website and filling in all the mandatory fields of the registration form (first name, last name, e-mail address, telephone number, login password) and, at the Visitor’s discretion, filling in the optional fields, thereby providing data about themselves to METALINIAI.LT (hereinafter referred to as Data).

2.2. METALINIAI.LT has the right, at its discretion, to use all data provided by the Visitor during the registration process, as well as other data about the Visitor collected by METALINIAI.LT in other ways.

2.3. The Data collected from the Visitor during the registration process and/or when using the Website and/or Services is divided into:

2.3.1. Anonymous data. METALINIAI.LT collects anonymous data related to facts that cannot be applied to an individual Visitor. For example, METALINIAI.LT collects certain information each time a Visitor visits the Website in order to improve the quality of browsing the Website. METALINIAI.LT collects the IP addresses and related data of all Visitors (e.g., the last website address visited before entering the METALINIAI.LT network portal) and the types of browsers and operating systems (e.g., Firefox browser. OS Windows). METALINIAI.LT also collects general search terms from various search engines focused on internal advertising. METALINIAI.LT collects this information from all Visitors for the purposes of monitoring and improving the Services and for direct advertising. METALINIAI.LT also collects information about Visitors’ responses to questions asked on the Websites in order to find out Visitors’ opinions about the Services and the advertising placed on the Websites. METALINIAI.LT receives this information from all Visitors, regardless of whether they are registered or not.

2.3.2. Personal data. This is data that can be used to identify a specific Visitor. Within the meaning of the Personal Data Protection Law of the Republic of Lithuania, this data is considered personal data. Such data is collected and processed only with the Visitor’s consent, in the following ways:

2.3.2.1. Registration: when a Visitor registers on the Website, the Visitor must provide the following data: first name, last name, email address, telephone number, login password. At their own discretion, the Visitor may also provide the following information: personal identification number (if they wish to receive an invoice), residential address (if they wish to have the ordered goods delivered to their home).

2.3.2.2. Correspondence and communication: if the Visitor contacts METALINIAI.LT, METALINIAI.LT may store records of such communication and other related information.

2.3.2.4. METALINIAI. LT has the right to collect data about the Visitor when he logs on to the Website. This data shows which pages of the Website the Visitor visits, at what time and how often he does so, and which services he uses. This information also includes data that the Visitor sends to the Website.

2.4. The data subject may at any time contact the administration of the METALINIAI.LT online store and familiarize themselves with their collected data and request that it be corrected, destroyed, or that the processing of their personal data be suspended when the data is processed in violation of the provisions of the law.

3. DATA RECIPIENTS

3.1. METALINIAI.LT processes, handles, and uses the collected Anonymous Data for self-promotion and other similar purposes. Anonymous Data may be transferred to third parties and published publicly.

3.2. METALINIAI.LT processes the collected Personal Data in strict compliance with the provisions of the Personal Data Protection Law of the Republic of Lithuania. METALINIAI.LT processes Personal Data only for the following purposes: to establish the identity and contact details of the person purchasing goods on the Website; to create a login account on the forum operating on the Website; to establish the identity and contact details of persons who wish to submit complaints and suggestions to METALINIAI.LT using a special module installed on the Website; with the Visitor’s consent – for direct marketing purposes. Personal information is not transferred to any third parties, except in cases where this is required by the laws of the Republic of Lithuania.

3.3. The Website may contain active links (hyperlinks) to other websites. Some of these websites may collect the Visitor’s personal information, and advertising websites may use cookies and web beacons in their advertisements to collect information about the Visitor. METALINIAI.LT’s Privacy Policy and the provisions set forth therein do not cover the privacy policies and information collection practices of third parties. METALINIAI.LT is not and cannot be held responsible for the actions of any third parties that collect information about the Visitor.

3.4. The data subject has the right to obtain information about the recipients to whom his or her personal data has been provided over the past year.

4. COOKIES AND NETWORK DATA COLLECTORS

4.1. The visitor understands and agrees that METALINIAI.LT collects anonymous data using cookies and network data collectors.

4.2. A cookie is a small text file with a unique identification number that is transferred from the website to the hard drive of the Visitor’s computer so that the website administrator can distinguish the Visitor’s computer and see the Visitor’s activity on the Internet. The unique number identifies the Visitor’s browser each time the Visitor visits the Website. Cookies do not allow websites to remember any personal information about the Visitor (such as the Visitor’s name and address) that the Visitor may have forgotten to keep confidential. Cookies allow METALINIAI.LT to automatically remember the type of the Visitor’s web browser when the Visitor visits the Websites. In order to offer the Visitor the best possible quality of service, METALINIAI.LT uses cookies to:

4.3.1. provide products and services of the highest quality and efficiency. By storing certain information in cookie files or linking cookies to the registration process, favorite websites, or a brief description of the Visitor in the METALINIAI.LT computer system, METALINIAI. LT can provide Services much faster and more efficiently to a larger number of Visitors. This information is usually stored in an encrypted form that can only be decrypted by METALINIAI.LT;

4.3.2. protect the Visitor from the unlawful use of their Data.

4.3.3. keep statistics, such as the number and flow of Visitors. Such information is not linked to the Visitor’s personal information.

4.4. The use of cookies is an industry standard and is used by many websites. It is possible to prevent cookies from being stored on the Visitor’s computer or to disable all forms of cookies. In this case, some of the Services may not function partially or completely.

4.5. Web beacons are small graphic files that METALINIAI.LT may place on the Websites and in emails that METALINIAI.LT sends to the Visitor. Cookies and web beacons together allow METALINIAI.LT to accurately count the number of unique Visitors to the Websites and the number of views of the relevant Websites. Using web beacons, METALINIAI.LT can also find out how many times a specific website, which was advertised to the Visitor by email, has been viewed. Such information is not linked to the Visitor’s personal information.

4.6. Any image on the Website may be a web beacon. Third parties advertising on the Websites or by other means may use web beacons in the advertisement itself.

4.7. Since web beacons work in conjunction with cookies, the Visitor can prevent web beacons from collecting the Visitor’s information by setting their browser to not accept any cookies or only cookies from the Website.

5. USE OF VISITOR INFORMATION

5.1. METALINIAI.LT has the right, at its discretion, to use all information collected about the Visitor in any way that is not prohibited by the laws of the Republic of Lithuania. The following are examples of the purposes for which METALINIAI.LT may use the information collected about a specific Visitor:

5.1.1. in order to edit the Content in a way that is most relevant to the Visitor. In some cases, METALINIAI. LT needs to know the exact data about the Visitor in order for METALINIAI.LT to be able to offer specialized Services and targeted advertising;

5.1.2. METALINIAI.LT collects anonymous data about the Visitor and shares it with third parties (e.g., advertisers). METALINIAI.LT discloses information to such persons about the number of Visitors, the number of Visitors who saw a particular advertisement and/or clicked on a particular link on a particular Website, etc. METALINIAI.LT may also provide complete demographic statistics on those Visitors who noticed and clicked on the link of the relevant advertiser. METALINIAI.LT may also disclose anonymous survey results. This process does not usually disclose any personal information about the Visitor;

5.1.3. METALINIAI.LT also uses aggregate data for statistical analysis of general characteristics and Visitor behavior in order to identify needs related to certain parts of the Website and to analyze how and where to most effectively use available resources. Without this data, METALINIAI.LT would not know which parts of the Website are most popular and would not be able to properly modify and edit the Content and Services offered;

5.1.4. METALINIAI.LT may use the Visitor’s personal information in order to contact the Visitor and inform them about changed and updated Services, as well as about the Visitor’s accounts or violations of the Rules. If the Visitor participates in games or competitions organized on the Website, METALINIAI.LT may use the Visitor’s information if the Visitor wins and METALINIAI.LT needs to contact them;

5.1.5. METALINIAI.LT may send e-mails or letters by post, as well as short messages (SMS) to the Visitor’s mobile phone with information about Services that, in the opinion of METALINIAI.LT, would be of interest to the Visitor. The aforementioned information is sent only if the Visitor has given their consent.

6. PROTECTION MEASURES

6.1. METALINIAI.LT uses software and other measures to protect the Data of all Visitors. Only authorized METALINIAI. LT employees and/or other persons authorized by METALINIAI.LT.

6.2. METALINIAI.LT asks Visitors to be careful when using and storing Data, as Visitors are responsible for the confidentiality of all Data. The Visitor should log out of the browser after finishing work to ensure that no one can access the Visitor’s email, personal information, especially in cases where the Visitor uses a publicly accessible computer (e.g., in an internet café or library). METALINIAI.LT also warns that the Visitor should be cautious and should not disclose their personal information (such as the Visitor’s real name, personal identification number, email address, bank account codes, etc.) to third parties when using the Website and/or Services. Such information may be used and directed against the interests of the Visitor, as well as for activities such as fraud, sending unwanted emails, etc.

6.3. METALINIAI.LT undertakes to endeavor to protect the Visitor’s personal data processed by METALINIAI.LT, but considering that the Visitor’s information is sent via the Internet, METALINIAI.LT warns that METALINIAI. LT cannot and does not guarantee the security of any information transmitted by the Visitor, including personal data.

6.4. METALINIAI.LT cares about the protection of the rights of minors and restricts their ability to use certain Services intended only for adults. Therefore, certain parts of the Website may be intended only for adults. Minors are strictly prohibited from accessing such parts of the Website. Visitors are also responsible not only for their own behavior on the Website, but also for the behavior of their minor children or other persons under their care if they use the Website in the Visitor’s environment, with the Visitor’s permission, or using the Visitor’s hardware.

7. SOFTWARE USED ON THE WEBSITE AND ITS INSTALLATION.

7.1. METALINIAI.LT may make available for installation, at its discretion, software selected for use with certain Services. The Visitor understands and agrees that METALINIAI.LT may restrict the Visitor’s ability to use certain Services in cases where certain software is not installed. Such software may be developed by both METALINIAI.LT and third parties. The software may be designed in such a way that it independently contacts the hardware of METALINIAI.LT or third parties in order for the installed software to function, as well as to enable the Visitor to learn about updates and improvements to such software. The terms and conditions of use of such software are discussed in a separate agreement, the text of which is available to the Visitor when installing such software.
